Couple Ordered to Sell Home After Drug Dealing Convictions

A married couple convicted of dealing cannabis were ordered to sell their home at court yesterday (Wednesday 22 April). The order repays the criminal benefit of their drug trafficking enterprise.

Mark Clarke, aged 50, and Jemma Clarke, 42, both of Webb Tree Avenue, Hereford, were sentenced at Worcester Crown Court. Charges followed a CID warrant at their home address in May 2023.

Convictions and Sentences

Both were convicted of possession with intent to supply a class B drug – cannabis. They were also convicted of possession of an offensive weapon in a private place. Further convictions included entering into/being concerned in the acquisition/retention/use or control of criminal property.

Mark Clarke received a total of 18 months in prison, suspended for two years. He was also given 200 hours unpaid work, a 25-day rehabilitation activity requirement, and a victim surcharge of £187. The confiscation and forfeiture of all drugs and paraphernalia were also ordered.

Jemma Clarke received the same sentence, except her unpaid work order was 150 hours. Further charges for both, of being concerned in the supply of a class B drug – cannabis and acquire/use/possess criminal property, were ordered to lie on file.

Investigation Details

The prosecution followed a warrant at their home address in May 2023. Officers found large amounts of cannabis and cannabis products in containers with an estimated street value of £7,340. Drug dealing paraphernalia, a knuckle duster, cash, and mobile phones showing messages about drug dealing were also discovered.

Analysis of their banking by West Mercia Police’s Economic Crime Unit (ECU) revealed cash deposits of £97,395 between January 2020 and April 2023 into a joint account. Regular payments into another account, some referencing ‘cake’, totalled £32,029 over the same period. An account registered to Jemma Clarke had deposits of £47,087.99 and withdrawals of £46,375.26 over the three years.

The criminal benefit was judged to be £187,580.00. An identified available amount under the Proceeds of Crime Act (POCA) of £154,200.00 was secured from the sale of their home. The money must be paid within three months, or they will face a default sentence of 12 months in prison. The money would still be owed upon release from prison.

Police Statement

T/Insp Rachel O’Brien from the ECU said: “We are pleased to get this result under POCA for such a large amount which reflects the level of the Clarke’s drug trafficking and could put them behind bars if they don’t pay up. We hope this shows the public we will punish criminals in the pocket through the courts where appropriate so they cannot financially benefit from illegal enterprises such as this one.”
